Do you have to pay sales tax on a used car you buy from a person in Georgia? Someone told me there is no tax because it is paid at the dealer by original buyer, is this true? I know it wasn’t like that in FL. Thanks for your help. Will call DMV tomorrow, but just wanted to ask here first.

Q: Should we move to Georgia from California?
We are recently retired, own a small home in So. California on a main street in a fast growing town. We’re unhappy with the fast growth, so many people, and too many cars. Because of our medical insurance and finances, if we sell our home and relocate, our only option to be closer to our kids is Georgia. We want to use the profit from the sale of our home in Calif. to pay cash for another home so we won’t have a mortgage payment. We will be going there soon to check it out. Does anyone have any advice for a native Californian about Northern Georgia? Weather, bugs, etc.? We’re looking at Cartersville and Acworth (just north of Atlanta).
A: I was born and raised in Atlanta, so I’ll tell you what I can.
By living in Ackworth or Cartersville, you should be able to avoid a lot of the growth that seems to be happening lately. I lived in Roswell and Marietta for a time, and I don’t even recognize it anymore!! It’s been a while since I’ve been up north, but that has always been a quiet part of the state.
We do have our share of cold winters, but that’s nothing compared to the muggy summers. I was stationed in California for 2 1/2 years (Vandenberg Air Force Base near Santa Barbara) and the dry heat just didn’t compare with the humidity in Georgia. Be prepared to find a pool or soak yourself with hose when May or June comes around!!!
Georgia also has it’s fair share of mosquitos (especially far from the city areas) in the summer, so it might be a good idea to keep a can of “Off” on hand.
As far as recreation goes, Georgia has plenty to offer. If you like amusement parks, look no further than “Six Flags Over Georgia”. While it’s not as pristine as Disney or other parks with the “Six Flags” moniker, there are plenty of coasters to challenge all. Stone Moutain is a great outdoor spot to spend a long weekend. Be sure to head there in the summer to check out the nightly laser show. If you are a sports fan, downtown Atlanta is the place to be. Even if you are not a fan of the Georgia teams, you can go to Turner field for baseball (one of the best ballparks in major league baseball), the Georgia Dome for football, and Phillips Arena for hockey.
There are just too many things to list, so I suggest finding a guide to downtown Atlanta to find what you like.
The people are also very friendly. I have brought many friends from all around the country to visit my home state, and each person has commented on how friendly and helpful everyone is. I’m not saying there aren’t any unsavory types in Georgia, but you will be hard-pressed to find one.

I’m 18 years old, and I’m looking for my first car. It will mainly be used to get home from college which is only about 30 miles away. I need a car that has the best gas mileage for the cheapest price. My budget is $2000, and of course the car will be used. I prefer a manual.

Q: I sold my car last weekend, now the guy wants his money back…?
I have read all the other questions like this and I get the same answer just about every time. But I am just being extra cautious.
I sold a 1995 Saturn SC1 last week to this guy. We negotiated a price of $775 because it needed a new radiator and a tune-up. I made sure he knew that my husband drove this car to his job everyday without problems. That the radiator needed to be changed before driving it a long way. He said ok and we made the transaction. I wrote on the biil of sale “Car is sold AS-IS” He signed the title and went and registered it. Now (a week later) he comes knocking on my door saying “We got problems.” He said he took it to a local dealership that checked it out and the mechanic says the rings are bad. He says he wants his money back or me to pay for the repairs. I told him I would check it out and get back to him. I researched it online and found that the lemon laws here in Georgia only apply to dealers and new cars. I, also found that private party sales are not mentioned in the law. I printed out the page from the GOVERNMENT website stating the law and took it to him. He says that there is another law regarding used cars. I have checked it out and found nothing. He informs me that he has an attorney on retainer and he will be contacting him tomorrow about this. I know I told him the car needs repairs and that my husband drove it with no problems. He drove it everyday! The guy test-drove the car and checked the oil and looked the car over really good and still took it home. Does he have the right to demand his money back or take me to court? Or does what I wrote on the bill of sale stand AS-IS?
A: Don’t stress about this one second. Its a $775 car.
You wouldn’t be responsible even if you had not written as-is on the bill of sale.
Don’t worry about it. Chances are any lawyer is going to tell him he doesn’t have a case except to try and scare you into giving his money back.

There are no lemon laws for private party sales anywhere in the US. AS-IS means as-is.
If you didn’t write as-is, it would still be implied.
Save your bill of sale and don’t worry about it.
If by some fluke he does sue you, dont worry. But be sure to show up in court, show the bill of sale and explain your side. I give you a 99%+ chance of winning.
If you fail to show up in court, he could win a defaultjudgmentt, which means you owe him for the $775 plus court cost.
But, I doubt he sues, Im not sure if it costs $35-75 to sue butthat’ss just good money after bad for him. He’d be an idiot to do it because he has no chance of winning unless youdon’tt show up.

Jose Genao sells used cars for a living, but lately he’s had to turn away customers from his Smyrna dealership.
Genao used to sell about 15 vehicles a week, mostly Ford F-150 or Silverado pickups to a Mexican clientele. Now he sells only two or three.
Half a dozen customers have returned cars because they can’t register them.
“They bring the key and tell me, ‘Jose, I’m leaving,’ ” Genao said.
Genao is feeling the fallout from a new state law, effective July 1, that requires a valid Georgia driver’s license or ID card to register a car in Georgia.
The law is cutting deep into traffic for many auto dealers and tag and title services catering to the state’s growing immigrant community. Illegal immigrants can’t get driver’s licenses because to do so, they must prove they’re in the country legally.
The law also has the potential to cut into sales taxes and county ad valorem tax revenues, though metro area counties say it’s too early to measure that effect.
The bill’s sponsor, Sen. Chip Rogers (R-Woodstock) said he did not target immigrants.
“Yes, this will impact people who are here illegally, but my biggest focus is public safety,” he said.

A: I think that is a very valid and necessary law. The guy who said that they are dangerous isn’t just talking to hear himself yammer. It’s the truth. In my hometown, quite a few years back, a crowded van full of illegals went the wrong way down an interstate (more than likely because they could not read english). If i remember correctly, they killed themselves plus an oncoming vehicle.

Situation didn’t make sense. A doctor in Georgia wanting to buy a 20 year old used car from Toronto, get it shipped, etc.?
Looked into it, decided it was a scam. Found info. on the web about similar scams where people send fake checks, the seller cashes them at the bank no problem, then awhile later when the check gets to some official place, it’s found to be counterfeit, then the seller owes the bank the money.
Anyway, I’ve already got rid of the car, then a month later this bozo tells me a check’s on the way. I told him the car’s gone. He said to inform him when the check arrives. I’m thinking of sending it somewhere, like the bank it’s issued from.
Ideas?
A: Great idea ! ! Just be certain that when you open the envelope you’re wearing plastic gloves so that the only fingerprints on the check and inside the envelope are the sender’s. Then send the envelope and its contents to the bank along with a note that states you think it’s fake and any fingerprints on the check or inside the envelope are not yours. Perhaps they’ll be able to use the information to track down the scammer. Wouldn’t that be wonderful?

A: Like the first responder said , take your bill of sale and any other paperwork you obtained from seller to the DMV or whatever you call the office there and they will guide you thru the steps as to filing for a lost titile. Set aside a little extra money for this. I know hear you must put up a bond and the titling fees which all in all winds up running about 500 bucks and a couple of months of time. Next time i would not bother with the hassle of buying a car unless they have a title or it is just one unbelievable bargain that is still a bargain when all the headache is said and done.

I bought a car 3 weeks ago, the buyer was supposed to use the money to pay off the loan and then send me the title. She gave me a bill of sale so I could drive the car for the 30 days until I had to have it registered. I called her last week and she said give her another week. I have to have the car registered in another week or I will have to pay penalties. What can I do if she doesn’t pay the loan or does not give me the title? Can she get in trouble for selling me a car without paying the loan off? What are my options? I live in Georgia if that makes a difference.

A: What you need to do is go back to her and demand your money back. Other wise you will take her to small claims. That should put the fire under her butt to get the title from the bank. if she still hasn’t paid the loan off then it’s time for her to give you your money, if she doesn’t have it, take her to small claims. thats pretty much it.

I’m new at the whole car buying thing, and I have a question.
Would a dealership take something like $50 or more for money down on a used truck? It’s about $3,000 and I’m thinking of paying may be $73/mo. for 60 months.
I have a DJ job this week and I’ll get may be $50 and I start working again next month, right now I’m talking to my boss if I can start next week instead of next month.
Also, how much would sales tax cost for a car in Georgia?
Plus what are some other fees for buying a car? I know there’s registration, tax, and title, but is there others?

A: If its only $3k, you will probably not get 60 month financing. Its an older truck if it is selling for that price.
Also, since its a $3k truck, its likely at a mom-n-pop used car lot, or a buy here / pay here lot. That means they will either want the whole price up front, or finance it themselves. Look for terms more like 12 months at the outside, and likely wanting more $$ down. $50 to drive off is pretty low.
If you do go so far as to start seriously trying to buy this truck, PLEASE spend the $ to get a mechanic to look it over. You dont have a lot of money, and you are not making much. So you cant afford to pin yourself to a car payment on a truck that is a POS. The $ for an inspection may help you avoid a potential disaster.

I have a car loan at 5.8%, I need to get rid of the obligation to meet a required income:debt ratio with my new mortgage (also in my name only).
How can I transfer the loan obligation to my wife? Do I need to sell the car to my wife, payoff my loan, and have her get a used car loan (which is a better rate anyway).
IMPORTANT: If I do this am I obligating either of us for sales tax? Also I already paid ad velorum tax on this in April (my birthday), I believe that is prorated/refunded and she would pay it in July (her birthday). Correct?

To clarify, today, my wife has about the same income, job security, credit, as myself so I am not worried about those differences.
The reason I need to do this is to refinance an existing loan. To answer a question below, I was already married at the time of the original loan, and had no problem getting the loan in my name alone (she did not have a sufficient length of credit history). The issue now is that stupid ratio is being compared to my own income, not my household income (which is basically double).
A: If she is not co-signed now and you want her to take over the loan, the lender will run a credit report on her to determine if they will write her a loan or not. They may, they could turn her down for a variety of reasons (new on the job, income level, payment history, available credit, etc). And if her credit is not as good as yours, chances are the interest rate will be higher than 5.8%. They will also look at the value of the car vrs. the loan amount requested

Q: Does putting someone else’s auto tag and auto insurance in your name give you any ownership of the vehicle?
This was done in the state of Georgia. I bought, own and restored an old VW camper bus. I went short on funds and my girlfriend at the time wanted us to use t he camper bus. Her insurance would be a lot cheaper than mine, so she got a tagand insurance for the bus, but she put them in her name. While we were together, I thought that was fine. But now that we are not together, she thinks that she has part ownership of the vehicle. I have the bill of sale from when I purchased the car, she has never had the such but was supposed to in order to have gotten the tag in her name. In a court of law, where does her old tag get her?
A: Who’s name is on the title? They are the one that owns the car. I’m wondering how she was able to get plates on it if the VW was in your name and her name wasn’t on the title.
Go down to the DMV or county clerks office and get this straightened out. Get the registration in your name and cancel the other tag. It should have never happened but it did now get it straight and then you won’t have any more worries. Good luck with it.
