Q: In a private auto sale who is responsible for the saftey and emissions inspections?
I am about to buy a car off a private party. Who is responsible for getting the car’s safety and emissions inspections done, the buyer or the seller? I would think the seller would do this to increase the odds of selling the car but is there a law (in Missouri) that says the car must be inspected before the sale? I know it needs to be inspected before registering.

A: The inspection should be an agreement between the buyer and seller. If the seller agrees to do it prior to the sale, then he should show proof of the inspection. If the buyer agrees to do it, then “Buyer beware,” and the auto is sold “as is.”

I sold my car to a dealership in Australia and I need a bill of sale that is more detailed than the general bill of sale between two parties because it is overseas and it is a classic car.
A: Then put whatever detail you’d like into the bill of sale, and give it to the buyer. Use a normal bill of sale as the jumping off point, and add to it.

A: If you mean a Bill of Sale, just write up one stating the date, the vehicle description, VIN number, mileage, sale price, names and signatures of buyer and seller.
If you are thinking about selling your car to someone and accepting payments, DON’T DO IT. There are hundreds of horror stories on this answer board of people who did it, and now regret it.

A: Well , you should’ve got a Title/ or a bill of sale… did it state they’d produce a title/ or that one would be mailed to you? if they sell you an inferior car yes you should be able to take it back even if it is “AS-IS” it must run and past any emissions… most states require that as part of sale…Title write down VIN # and go to local DMV to make sure seller had a right to sell it?? WOrd here is , Fraud.
Q: Can I cancel an auto sale if I signed the sale and loan papers but did not drive the car off the lot yet?
I signed paperwork at the dealer’s for a used car (in MA) but we took our “old” car home for the night to clean it out and left our “new” car in the dealer’s lot. Now I have buyer’s remorse. It’s a fine car, the dealer did not cheat me, but it’s not what I want. Can I get out of this deal? I did not put any money down.

Let me repeat that – there is no federal law requiring a dealer or seller to take a car back – you don’t have 24 hours during which you can change your mind, you don’t have three days to reconsider – when you buy a car it becomes your property.

•Don’t sign any sales contracts, lease contracts or finance contracts unless you are 200% certain that you want to go through with the deal and buy the car.
•Don’t give any car dealer or private party a deposit on a car deal unless you are absolutely sure you are going to see the deal through to it’s final conclusion. A deposit is not a legal requirement. The seller wants the deposit so they can exert control. They want your money locked in before any “Buyer’s Remorse” can occur.
•The time to mull over the purchase is BEFORE you make the purchase. Take a day or two and sleep on the deal before you make your decision.
